These Terms of Service ("Terms") govern your access to and use of the Kanakaw website, applications and API (collectively, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Kanakaw provides AI-powered content generation tools, including text-to-image generation, image editing and upscaling, and text/image-to-video generation. Generated results depend on machine-learning models and may vary; we do not guarantee any particular output quality or fitness for a specific purpose.

2. Accounts

• You must provide a valid email address and keep your credentials confidential. You are responsible for all activity under your account.
• You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
• We may suspend or terminate accounts that violate these Terms.

3. Credits and Payments

• Generation is credit-based. Each job consumes credits according to the price displayed before you start it.
• Credits for failed or cancelled jobs are refunded automatically to your balance.
• Purchased credits are non-transferable. Except where required by law, purchases are non-refundable once credits have been consumed.

4. Acceptable Use

You agree not to use the Service to create, upload or distribute content that:

• is illegal in your jurisdiction or in the jurisdiction where the content is accessed;
• depicts or exploits minors in any way;
• infringes intellectual-property rights, privacy rights or publicity rights of others;
• depicts identifiable real persons without their consent, or is intended to harass, defame, deceive or impersonate any person;
• constitutes spam, malware, or attempts to disrupt or gain unauthorized access to the Service.

We may remove content and suspend accounts that we reasonably believe violate this section.

5. Your Content and Generated Output

• You retain ownership of the inputs you upload ("Input") and, to the extent permitted by law, the outputs generated for you ("Output").
• You grant us a limited license to host and process Input and Output solely to operate and improve the Service.
• You are responsible for how you use Output, including compliance with applicable laws and third-party rights.

6. API Use

API access is provided through API keys issued by Kanakaw. You must keep keys confidential, must not share them between projects without our approval, and must not exceed rate limits or circumvent feature restrictions attached to a key. We may revoke keys at any time for abuse or non-payment.

7. Intellectual Property

The Service, including its software, design and branding, is owned by Kanakaw and its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in the Service other than the limited right to use it as intended.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Kanakaw shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Changes

We may update these Terms from time to time. Material changes will be announced on this page with an updated date. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
